UE 2019/882 (EAA)
Introduction
SIMEL Motor Spa is firmly committed to transparency, accountability, and compliance with European
regulations. This page aims to clearly and thoroughly explain our position with respect to Directive (EU)
2019/882, also known as the European Accessibility Act (EAA), which enters into force on 28 June 2025.
What is Directive (EU) 2019/882 – EAA?
The EAA aims to ensure that certain digital products and services intended for end consumers, including
people with disabilities, are made accessible through compliance with the technical accessibility standards set out in WCAG 2.1 – Level AA.
WCAG (Web Content Accessibility Guidelines) 2.1 Level AA is a set of technical standards developed by the W3C to ensure that digital content is:
• Perceivable (e.g., alternative text for images, readable color contrast),
• Operable (e.g., keyboard navigation),
• Understandable (e.g., simple language, explicit error messages),
• Robust (e.g., compatibility with screen readers and assistive technologies).
These standards define the minimum requirements that websites and apps must meet to be considered
accessible to all users, including those with visual, motor, cognitive, or auditory disabilities.
The directive applies to websites, apps, electronic devices, banking services, e-commerce platforms, digital
transport systems, and other services directed at the general public.
Who must comply
The directive applies to companies that meet both of the following criteria:
1. They offer digital products or services to end consumers (natural persons acting for non–
professional purposes)
2. They have at least 10 employees or an annual turnover/balance sheet exceeding €2 million
Why SIMEL is exempt from compliance
After careful analysis of the legal text and in line with the interpretative principles of the Directive, SIMEL Motor Spa does not fall within the scope of application of the EAA, for the following reasons:
1. Exclusively B2B business model
SIMEL designs and manufactures custom electric motors exclusively for other companies.. We do not sell, promote or offer any products or services to private individuals or end consumers.
2. No digital consumer contracts
The SIMEL website does not allow contracts to be concluded online by individuals. The contact forms are intended solely for professionals and businesses and explicitly require business-related information.
3. No direct sales or digital services to the public
SIMEL does not manage e-commerce platforms, sell online, or mediate digital transactions. Downloadable content (e.g., technical catalogs) is intended for professional use only.
4. Distributors operate independently
The “Distributors” section only provides information and contact details of authorized partners, who operate with full commercial independence. SIMEL is not involved in direct transactions with end users.
5. Products excluded from the Directive
Electric motors are industrial components and do not fall into the product categories covered by the Directive, which includes interactive terminals, payment devices, consumer hardware, e-readers, etc.
Voluntary compliance and transparency
Although not subject to mandatory compliance, SIMEL supports the principles of universal accessibility and is committed to keeping its content as accessible as possible to all visitors, within the limits of its technical and industrial context. If any unintentional accessibility issues are encountered, they can be reported to our team via the contact form.
Formal declaration
SIMEL Motor Spa hereby declares that, as of today, its business operations are fully B2B in nature, and that no part of its website offers digital products or services intended for end consumers, nor does it enable the
conclusion of consumer contracts as defined in Directive (EU) 2019/882.
As such, the company is legally exempt from the compliance obligations set forth by the Directive.This evaluation has been conducted internally based on the official legal text and is available for inspection by the competent authorities if required.
